Terms of Service

These Terms of Service govern your use of the Haus of Cherokee website and your purchase or use of creative, digital, website design, branding, and recurring Website Care services provided by Haus of Cherokee, operated by SmokinBLING LLC.

Acceptance of Terms

These Terms of Service (“Terms”) apply to your use of the Haus of Cherokee website and to all services provided by Haus of Cherokee.

By using our website, purchasing a service, submitting payment, completing a client intake, approving work, or enrolling in Website Care, you agree to be bound by these Terms. If you do not agree, please do not use our website or services.

Services

Haus of Cherokee provides custom website design, brand identity design, digital menus, graphic and digital design, business design solutions, website care and maintenance, and related creative services.

The exact deliverables, features, and inclusions for any engagement are controlled by the specific service you purchase, together with the applicable proposal, invoice, checkout description, or written agreement. Materials on our website describe our offerings generally and do not by themselves create a commitment to specific deliverables.

Payments

Payment terms vary by service and project.

  • Some services may require payment in full at the time of purchase.
  • Some projects may require a deposit before work begins.
  • Project work begins after any required payment or deposit is received.
  • Final balances may be required before launch, transfer, or final delivery of project files.

Project-specific payment terms stated in your proposal, invoice, checkout description, or written agreement control over these general Terms where they differ.

Custom Creative Services and Refunds

Because Haus of Cherokee provides customized creative and digital services, payments and deposits are generally non-refundable once project work has begun, unless otherwise agreed in writing or required by law.

If you have questions about a payment, please contact us at info@hausofcherokee.com and we will work with you in good faith to resolve it.

Website Care

Website Care is offered at $59 per month and may include:

  • Technical website upkeep
  • Form monitoring
  • Domain and DNS assistance
  • Up to two minor content updates per month
  • Priority website support

Minor content updates may include existing text changes, business hours, existing pricing, image swaps, and basic contact information.

Unused monthly updates do not roll over to the following month.

Website Care Not Included

Website Care does not automatically include:

  • New pages
  • Redesigns
  • New forms
  • New functionality
  • Major copywriting
  • Large content additions
  • Custom integrations
  • Major menu rebuilds
  • E-commerce builds
  • Structural redesigns
  • Third-party software fees

Requests in these categories may require a separate quote before any work is performed.

Recurring Billing Authorization

Enrollment in Website Care authorizes recurring charges to your payment method on a monthly basis.

Recurring charges continue until canceled in accordance with these Terms. Clients must maintain a valid payment method on file for the duration of their enrollment.

If a payment fails, Website Care services may be suspended until the account is brought current.

Website Care Cancellation

Website Care may be canceled by written notice to info@hausofcherokee.com.

Cancellation stops future recurring charges after the applicable billing period. Charges for the current billing period are generally not prorated or refunded unless required by law or agreed in writing.

Any outstanding balances for services already provided remain due and payable.

Payment Processing

Payments may be processed through Stripe or another third-party payment processor.

Haus of Cherokee does not directly store complete payment card numbers. Card details entered at checkout are handled by the payment processor, which maintains its own security and privacy practices.

Client Intake and Project Information

Clients are responsible for providing accurate and complete information through intake forms and project communications.

Clients are also responsible for providing timely materials, content, approvals, login credentials, images, and access as needed for us to perform the services. Delays in providing these items may extend project timelines.

Client Materials

Clients represent and warrant that they own, or have obtained permission to use, all logos, photos, text, trademarks, graphics, testimonials, videos, documents, and other materials supplied to Haus of Cherokee.

We may reasonably rely on this representation when incorporating client materials into project deliverables.

Project Timelines

Project timelines communicated by Haus of Cherokee are good-faith estimates unless a specific timeline is expressly guaranteed in writing.

Timelines may be affected by client response times, material availability, third-party platforms, and other factors outside our reasonable control.

Revisions

The number of revisions included with a project depends on the specific service, package, or proposal purchased.

Revision requests beyond those included may require additional fees, which will be communicated and agreed upon before the work is performed.

Scope Changes

Requests that fall outside the original scope of a project may require a separate quote.

We will identify when a request appears to exceed the agreed scope and will provide pricing for your approval before proceeding.

Client Approval

Clients are responsible for reviewing all project deliverables carefully before launch or final delivery, including spelling, pricing, contact information, business details, images, links, policies, and factual information.

Approval of deliverables by the client confirms the content is accurate and ready for publication.

Third-Party Platforms

Websites and services we build may rely on hosting providers, domain registrars, payment processors, databases, plugins, analytics systems, email platforms, ordering systems, reservation systems, and other third-party integrations.

Haus of Cherokee is not responsible for third-party outages, policy changes, discontinued products, or pricing changes that are outside our control.

Domain Names

Clients are encouraged to maintain ownership and control of their domain names whenever possible.

Domain registration and renewal fees may be separate from service fees unless specifically included in your agreement.

Haus of Cherokee does not claim ownership of client-owned domains.

Website Transfer

Upon request, Haus of Cherokee will reasonably cooperate with transferring a website to a supported client-owned account or platform.

Additional work beyond reasonable cooperation, or fees charged by third-party platforms, may apply and will be communicated in advance.

Intellectual Property

Clients retain ownership of all materials they provide to Haus of Cherokee.

Upon full payment, clients receive the rights to the final custom deliverables as described in their agreement with us.

Haus of Cherokee retains ownership of its internal systems, methods, templates, reusable frameworks, processes, and pre-existing intellectual property, which may be reused in other engagements.

Third-party assets incorporated into a project, such as fonts, stock imagery, plugins, or licensed software, remain subject to their original licenses.

Portfolio Rights

Haus of Cherokee may display completed work in its portfolio, website, social media, presentations, and promotional materials unless otherwise agreed in writing with the client.

If you would like to exclude your project from our portfolio, please contact us at info@hausofcherokee.com.

Cancellations and Termination

Cancellation rights and obligations depend on the specific service and the stage of work at the time of cancellation.

For completed work and for approved third-party expenses incurred on a client's behalf, payment may remain due regardless of cancellation.

We may suspend or terminate services for nonpayment or material breach of these Terms after reasonable notice.

Chargebacks and Billing Disputes

If you have a billing concern, please contact us first at info@hausofcherokee.com so we can work to resolve it directly.

Initiating a chargeback does not automatically eliminate contractual payment obligations. Valid charges for services properly rendered may remain due.

No Guarantee of Results

Haus of Cherokee does not guarantee any specific business outcomes.

  • Profitability

Our services are creative and technical in nature, and results depend on many factors outside our control.

Limitation of Liability

To the maximum extent permitted by law, Haus of Cherokee, operated by SmokinBLING LLC, its owners, and its team members shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to these Terms, the website, or the services, including lost profits, lost revenue, lost data, or business interruption.

To the maximum extent permitted by law, our total aggregate liability for any claim arising out of or relating to the services is limited to the amount you actually paid to Haus of Cherokee for the service giving rise to the claim.

Indemnification

You agree to indemnify, defend, and hold harmless Haus of Cherokee, operated by SmokinBLING LLC, and its owners and team members from and against claims, damages, liabilities, and reasonable costs arising from materials you supply, your use of the deliverables, or your violation of these Terms.

Governing Law

These Terms are governed by the laws of the State of Georgia, without regard to conflict-of-law principles.

Changes to Terms

We may update these Terms of Service from time to time to reflect changes in our services, practices, or legal requirements.

The Last Updated date at the top of this page identifies the current version. Continued use of our website or services after an update constitutes acceptance of the revised Terms.
